1. Who we are

TravelAlert (the "Service") is operated by ArtMind Global LLC, a Florida limited liability company with its principal office at 3833 Powerline Rd, Suite 201, Fort Lauderdale, FL 33309, USA ("ArtMind", "we", "us"). By accessing or using the Service you ("you") enter into a binding agreement with ArtMind on these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. The Service

TravelAlert is an informational aggregator that surfaces publicly available emergency warnings. See the Safety Disclaimer for the full description of what the Service is and is not.

3. Eligibility and account

You must be of legal age in your jurisdiction to enter into this agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.

4. Acceptable use

  • You will not use the Service unlawfully or fraudulently, or to send spam.
  • You will not infringe any intellectual-property or other rights.
  • You will not interfere with the security of the Service (no malware, probing, scraping, or attempts to overload or reverse-engineer the Service).
  • You will not redistribute or resell aggregated alert data as your own.

5. Intellectual property

ArtMind retains all rights, title, and interest in and to the Service, including its software, documentation, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your personal, non-commercial use within the plan you have selected.

6. Subscriptions, billing and payment provider

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency conversion, invoicing, cancellation and refund mechanics are governed by Paddle's Buyer Terms.

6.1 Plans

TravelAlert is offered on two paid tiers: Essential (core alerts) and Voyager (Essential plus trip planning features). Voyager is priced approximately 30% above Essential. Each tier is available on a monthly or yearly billing cycle. The current price, billing cycle and tier for your subscription are shown at checkout and in your account settings.

6.2 Automatic renewal

Paid subscriptions renew automatically at the end of each billing cycle at the then-current price for your plan, until cancelled. You can turn auto-renewal off or back on at any time from your account settings or the Paddle customer portal. Turning auto-renewal off does not end your current billing period — you keep access until the period you have already paid for ends.

6.3 Changing plans

You can switch between tiers (Essential ↔ Voyager) and between monthly and yearly billing at any time. Plan changes take effect immediately and Paddle applies a prorated charge or credit for the remainder of the current billing period based on the price difference between the old and new plan.

6.4 Cancellation

You may cancel at any time; cancellation takes effect at the end of the current billing period and you retain access to your paid features until then.

7. Refunds

Paid TravelAlert subscriptions include a 30-day free trial and a 14-day money-back guarantee on the first paid charge. Full details are in our Refund Policy. Refunds are processed by Paddle.

8. Service availability

We do not guarantee uninterrupted or error-free performance of the Service. We may modify, suspend, or discontinue any part of the Service at any time.

9. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; sections that by their nature should survive (IP, disclaimers, limitation of liability, indemnification, governing law) will survive.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER ARTMIND GLOBAL LLC NOR ITS AFFILIATES OR LICENSORS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR FINANCIAL LOSS — ARISING FROM (a) YOUR USE OF OR INABILITY TO USE THE SERVICE, (b) MISSED, DELAYED, OR INCORRECT ALERTS, OR (c) YOUR RELIANCE ON ANY INFORMATION PROVIDED. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (ii) FIFTY U.S. DOLLARS (USD 50).

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless ArtMind Global LLC, its affiliates and licensors from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your unlawful use of the Service or your breach of these Terms.

13. Changes to the Service or Terms

We may update these Terms; material changes will be communicated through the Service. Continued use after changes constitutes acceptance.

14. Governing law and venue

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Disputes shall be resolved exclusively in the competent state or federal courts located in Broward County, Florida, except where applicable consumer-protection law grants you the right to bring proceedings in your country of residence.
